{"id":261,"date":"2020-05-01T14:47:01","date_gmt":"2020-05-01T18:47:01","guid":{"rendered":"http:\/\/westmichiganregional.com\/?p=261"},"modified":"2020-11-03T10:06:31","modified_gmt":"2020-11-03T15:06:31","slug":"what-happens-at-a-bond-hearing","status":"publish","type":"post","link":"https:\/\/westmichiganregional.com\/index.php\/2020\/05\/01\/what-happens-at-a-bond-hearing\/","title":{"rendered":"What Happens at a Bond Hearing?"},"content":{"rendered":"\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.findlawimages.com\/blogs\/placeholders\/Blotter2.jpg\" alt=\"Article Placeholder Image\"\/><\/figure>\n\n\n\n<p>After two days of hearings that included testimony from Walter Scott&#8217;s mother and brother as well as a 153-page motion containing performance reviews and a psychiatric evaluation for North Charleston Police Officer Michael Slager, who is charged with murdering Scott,\u00a0the judge deciding whether to grant Slager bond has yet to make a ruling.<\/p>\n\n\n\n<p>Although Judge Clifton Newman said today he will make a decision &#8220;as expeditiously as possible<a href=\"https:\/\/www.capebretonpost.com\/news\/local\/bail-hearing-set-for-sydney-accused-on-weapon-offences-444320\/\">,&#8221; the length of the hearings<\/a> and the lack of a definitive answer have left many wondering what is going on. What normally happens at a bond hearing? And why is this one different?<\/p>\n\n\n\n<p><strong>Bond Timing<\/strong><\/p>\n\n\n\n<p>Bail proceedings\u00a0determine an amount of money a criminal defendant must pay to secure his or her release until trial. Normally,<a href=\"https:\/\/newrepublic.com\/article\/156823\/limits-money-bail-fund-criminal-justice-reform\"> a bail or bond hearing is conducted<\/a> within days of a defendant&#8217;s arrest.<\/p>\n\n\n\n<p>For common or lesser crimes, the bail amount might be set automatically, and a defendant notified of his or her bond amount immediately after arrest. Even in serious cases, there are Constitutional limits on\u00a0how long after an arrest authorities can wait until conducting a bond hearing.<\/p>\n\n\n\n<p><strong>Bond Proceedings<\/strong><\/p>\n\n\n\n<p>During a bond hearing, a judge or magistrate <a href=\"http:\/\/burlingtoncriminallawyers.ca\/bail-hearing\">will consider\u00a0several factors in setting bail, <\/a>including standard bond schedules, the seriousness of the crime, and the defendant&#8217;s criminal history. Both prosecutors and the defense are allowed to offer evidence and testimony regarding the defendant&#8217;s ties to the community, his or her risk to public safety, and the risk that the defendant will flee or otherwise fail to attend his or her trial or pre-trial proceedings.<\/p>\n\n\n\n<p>Bond hearings\u00a0can take minutes or hours, but rarely do they last more than a day and even rarer are the cases where a judge delays his or her bond decision.<\/p>\n\n\n\n<p><strong>Bond in This Case<\/strong><\/p>\n\n\n\n<p>Slager was\u00a0charged with murder and arrested on April 7.
